On November 2, 2010, I was falsely accused of Residential Burglary and Theft in the 2nd Degree, which had occurred almost two years earlier. This was in Pierce County under Cause Number 10-1-04657-9. The home they claimed that I burglarized and stole property from is one that I had never been to or seen in my life. The Government accused me because it claimed that two fingerprints from my left hand were found on glass on a sliding door through which the Government claimed I made entry into the home. When I was contacted by law enforcement officers, I was adamant with them that I was never in the home they claimed I burglarized and that I was innocent. The police and the Pierce County Prosecutor’s Office did not believe me because of the fingerprints. I retained Mr. Johnston’s services. He believed me, in spite of the fingerprints. After having his fingerprint expert check the prints to ensure that the matching prints were mine, he then focused on establishing a timeline that would make the burglary impossible and on an explanation as to how my prints could be in the burglarized house. I remember Mr. Johnston telling me over and over again to “think, think, there has to be an explanation.” I finally remembered that my house had been broken into years earlier and that forensic specialists had been to my house. Latent fingerprints were taken from my house in an attempt to identify who had burglarized my home. Through excellent work by Mr. Johnston and his investigator, it was discovered that the technician had mislabeled the prints that were obtained at my home, which included my prints since I lived there, with the prints lifted from the burglarized home. Finally, my nightmare ended on July 19, 2011, when the charges against me were DISMISSED. I am a 42 year old widower raising my two teenage boys. I’ve worked at the same company for over four years as a welder. My world is my boys and my work. Had I been convicted, I would have had to serve a prison term and lost everything. After making some small talk I asked him what he was doing to make a living and he informed me that he was growing marijuana and that it was legal under the new laws and he was making a substantial amount of money doing so. He then “recruited” me to join him in his growing endeavor. He showed me documents that he claimed authorized him to grow marijuana for medical purposes and provided me with instructions of how to do the same. He made it very clear to me as to the amount of marijuana plants we could grow and it was totally legal and that I was not in any type of legal jeopardy.
Based upon the information my friend provided me, and doing some research on the internet, I agreed and we purchased the necessary lights and other equipment and set up a marijuana grow operation in the basement of my apartment. What I was not aware of was that my acquaintance and now new business partner had been under investigation for quite some time by the authorities and a short time after setting up our marijuana growing facility, my home was raided by police. They found 42 plants worth, according to police, $40,000.00 on the street.
I was arrested and charged with the unlawful manufacturing of a controlled substance – a serious felony.

Additionally, I was able to have returned to me, my cell phone and 2 televisions that were seized by the State when my apartment was searched.
